Nevada Attorney General Election 2026: Winner

The Trump administration has warned California election officials that processing ballots cast by suspected noncitizen voters could expose them to criminal investigation and prosecution. A letter from acting deputy attorney general Trent McCotter called noncitizen voting a federal crime and said officials who knowingly facilitate it risk being treated as aiders and abettors. The DOJ sued California after it missed a 48-hour deadline to cross-check a federal list of roughly 20,000 flagged names; federal prosecutors have since charged 28 green-card holders across California, 11 arrested, saying all appeared on that list. Secretary of State Shirley Weber called the demand unprecedented and said officials provided too little information to verify names. Governor Newsom calls the suit voter suppression; the dispute looms over competitive California House races in the midterms.

The Republican National Committee has confirmed South Carolina will keep its "first in the South" status for the 2028 presidential primary, voting fourth overall after Iowa, New Hampshire and Nevada. The decision, approved at an RNC midterm convention in Dallas, preserves an early-state order that has held for roughly 40 years. An exact date hasn't been set, but the contest will likely fall in mid-to-late February, with the full calendar expected by next summer, according to state GOP Chairman Drew McKissick.

South Carolina's Republican primary has been a strong bellwether, with its winner capturing the GOP nomination in every cycle since 1980 except 2012. Trump won the state decisively in 2024. With Democrats set to open their own 2028 calendar in South Carolina on January 22, and Trump term-limited out of the race, the state is shaping up as an early battleground for both parties, already drawing visits from prospective candidates and allies.

Roughly two dozen Democratic-led states and the District of Columbia, including Washington, Wisconsin, California and Pennsylvania, filed a new lawsuit against the U.S. Postal Service on August 26, challenging a rule implementing President Trump's executive order limiting mail-in voting ahead of the midterms. The suit, filed in a Massachusetts federal court, comes days after the Supreme Court lifted an injunction blocking part of the order, ruling the earlier Democratic challenge was premature rather than affirming its legality. California's suit followed shortly after, with Attorney General Rob Bonta calling the rule a "clear violation of the Constitution" and citing the state's heavy reliance on mail voting.

The USPS rule requires states to register mail voters into a new USPS database and get federal approval for ballot envelope designs featuring digital barcodes before ballots can be delivered; USPS says it won't deliver ballots to voters absent from the list or in noncompliant envelopes. State officials argue the rule violates the Constitution's assignment of election authority to states and risks disenfranchising voters this close to the election. The coalition seeks a temporary restraining order. The Department of Justice escalated its dispute with California over a list of voters flagged as possible noncitizens, filing an emergency lawsuit Oct. 15 in federal court in the Central District of California after state officials missed a roughly 48-hour deadline set by Deputy Attorney General Trent McCotter to review the names. DOJ had sent Los Angeles County Registrar-Recorder Dean Logan and Secretary of State Shirley Weber a password-protected thumb drive naming more than 20,000 "likely noncitizens," identified through a multiagency USCIS and Homeland Security Investigations review of state voter and federal citizenship data. The 15-page complaint accuses California of violating the Constitution's supremacy clause by knowingly sending and counting mail ballots from likely noncitizens, and asks the court to order the state to set aside such ballots until citizenship is verified. Attorney General Todd Blanche called the alleged practice "state-facilitated voter fraud."

Logan's office declined to open the drive, citing data privacy protocols, while Weber argued federal officials provided insufficient evidence. Governor Gavin Newsom called the lawsuit a "sad, desperate attempt" by President Trump to suppress California voters weeks before Election Day. The suit is the administration's first direct attempt to block vote-counting, following a broader push including a blocked citizenship-verification mandate, a mail-voting executive order partly struck down by the Supreme Court, and roughly 30 similar voter-roll suits against other states with limited success. Senate Democrats have demanded oversight briefings on the administration's election-interference efforts.

Nevada Attorney General Aaron Ford has appealed to the state Supreme Court to revive criminal charges against six Republicans accused in the 2020 "fake electors" scheme. A Clark County District Court judge dismissed the case in August, ruling prosecutors withheld exculpatory evidence from the grand jury and failed to show "fraudulent intent." The defendants—Michael McDonald, Jesse Law, James DeGraffenreid, Durward Hindle III, Shawn Meehan and Eileen Rice—had faced forgery charges for submitting a certificate falsely declaring Donald Trump the winner of Nevada in 2020. Trump pardoned them federally last year, but that pardon does not cover state charges. Ford, now running for governor against incumbent Joe Lombardo, says he expects the high court to side with his office.

The U.S. Justice Department sent Nevada Secretary of State Francisco Aguilar a litigation-hold letter confirming he is under investigation and demanding his office preserve records tied to the 2024 election. The notice came three weeks after a federal court dismissed the DOJ's lawsuit seeking Nevada's unredacted voter registration database, and just before the statutory 22-month preservation period under the Civil Rights Act of 1960 was set to expire. The DOJ had originally requested sensitive voter data, including Social Security numbers and driver's license numbers, which Nevada law bars from disclosure; a judge ruled the government failed to justify the demand.

Aguilar said his office is already preserving the records and complying with the letter's legal requirements, while accusing the administration of trying to intimidate state election officials ahead of the 2026 midterms. His office separately disclosed receiving seven DOJ subpoenas over voter information in recent months, though it's unclear if they relate to the investigation described in the letter. The DOJ has not detailed the scope of any case against Aguilar.

Luis Alberto Osorio of Elko, Nevada, pleaded guilty to straw purchasing of firearms, trafficking in firearms, harboring aliens, and conspiracy to launder money, the Department of Justice announced. Between April 2020 and September 2025, Osorio conspired with co-defendants to buy 140 firearms, including large-caliber and long-range weapons, along with magazines and ammunition, on behalf of individuals tied to drug trafficking organizations in Mexico.

Osorio also admitted to harboring people unlawfully in the U.S. to employ them at a Nevada mining company. Officials from HSI, the DEA, and the U.S. Attorney's Office for the District of Nevada framed the case as part of broader efforts to disrupt firearms trafficking networks that supply cartels and fuel cross-border violence. The investigation involved a multi-agency Department of Homeland Security task force, including the FBI, ATF, IRS-CI, and local Las Vegas police. Osorio faces a statutory maximum of 70 years in prison, with sentencing scheduled for February 11, 2027.

Republican Keith Faber and Democrat John Kulewicz, the two nominees for Ohio attorney general, have agreed to debate on Oct. 19 at Youngstown State University, becoming the first candidates in any of Ohio's nine statewide races to commit to facing off before the Nov. 3 election. The event, moderated by Tony Paglia of the Youngstown Press Club, follows a joint statement from both campaigns pledging a "free, fair, and informative" discussion for voters.

Faber, the current state auditor, has emphasized support for law enforcement, consumer protection, combating trafficking, and resisting federal overreach. Kulewicz has focused on consumer protection and price-fixing enforcement, arguing the office should prioritize state issues over national political lawsuits. Both candidates have outlined anti-corruption plans, and differ on continuing the prosecution of former FirstEnergy executives and on regulating license-plate camera technology. No debates have yet been scheduled in Ohio's higher-profile Senate or governor's races, where candidates have so far resisted or failed to arrange face-offs.

Arizona's attorney general race is heating up as Democratic incumbent Kris Mayes and Republican challenger Warren Petersen, the state Senate president, faced off in their first televised debate. Mayes, who narrowly defeated Abe Hamadeh by 280 votes in 2022 in a recount-triggering finish, is seeking a second term against Petersen, who won the GOP nomination in July over Rodney Glassman.

The debate turned combative over law enforcement, with Petersen citing Mayes' past comments about masked immigration agents, which drew criticism from police groups and Gov. Katie Hobbs, while Mayes countered by pointing to Petersen's legislative voting record on police-related bills. The candidates also clashed over immigration detention facilities, including a $1.2 billion federally funded expansion in Florence, ICE's role in Arizona, and how to handle young migrants brought to the country as children. They split over data centers, with Petersen favoring expansion under local control and Mayes urging caution. Their sharpest divide remains relations with Washington: Mayes has filed more than 50 lawsuits against the Trump administration over mail-in ballot restrictions, tariffs, and vaccine rules, while Petersen, a strong Trump supporter, has pledged to drop those challenges if elected.
