Austin McCollum, the Republican nominee for Benton County judge, has pleaded not guilty to charges of aggravated assault on a family or household member, first-degree false imprisonment, and second-degree battering. The charges stem from an Aug. 1 arrest over allegations he assaulted his wife, Ragen McCollum, 34, including preventing her from leaving a room, restricting her breathing, punching her, and slamming her head against the ground.

McCollum, 35, resigned his Arkansas House seat representing Pea Ridge and parts of Bentonville and Rogers shortly after his arrest, but state law does not allow him to withdraw from the county judge race except in limited circumstances, such as moving out of the county. He has faced calls from officials to step aside and has not said whether he would take office if elected. If he remains unconvicted of a felony, he could be sworn in as county judge, a role overseeing county government, roads, public safety, and finances. An omnibus hearing is scheduled for Dec. 1.
